These Terms of Service (“Terms”) govern your use of the INKAI – AI Tattoo Generator application (“App”) and website at https://www.mytat.ai (“Website”), operated by Rocket Digital Limited (“we,” “us,” or “our”). By using the App or Website, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

INKAI is an AI tattoo generator app that uses artificial intelligence to create custom tattoo designs from text descriptions and image inputs. The App provides AI-generated tattoo designs for reference and inspiration purposes.

3. User Accounts

• You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the App.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• Account authentication is managed through Firebase Authentication.

4. Subscriptions and Payments

• The App offers a free tier with limited daily generations and a Premium subscription for unlimited access.
• Subscriptions are processed through the Apple App Store or Google Play Store via RevenueCat.
• Subscription payments are managed by Apple or Google according to their respective terms.
• You may cancel your subscription at any time through the respective app store settings.
• Refunds are subject to Apple's or Google's refund policies.

5. User Content and AI-Generated Content

• You retain ownership of the text prompts and photos you submit to the App.
• AI-generated tattoo designs are created for your personal use. You are granted a non-exclusive, worldwide license to use, download, and share the generated designs.
• You may use AI-generated designs as references for tattoo artists.
• You must not use the App to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• We reserve the right to remove content that violates these Terms.

6. AI-Generated Content Disclaimer

• AI-generated tattoo designs are intended as reference art and inspiration. We recommend consulting a professional tattoo artist before getting any design permanently tattooed.
• We do not guarantee that AI-generated designs will be suitable as direct stencils without professional adjustment.
• The AI may occasionally produce unexpected or imperfect results. We continuously work to improve quality.

7. Advertising

The free version of the App displays advertisements served by Google AdMob. By using the free version, you consent to receiving ads. Premium subscribers receive an ad-free experience.

8. Intellectual Property

• The App, including its design, code, AI models, and branding, is owned by Rocket Digital Limited and protected by intellectual property laws.
• You may not copy, modify, distribute, sell, or lease any part of the App or its content without our express permission.
• The INKAI name, logo, and associated branding are trademarks of Rocket Digital Limited.

9. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose.
• Reverse engineer, decompile, or disassemble the App.
• Attempt to circumvent subscription requirements or usage limits.
• Use the App to generate offensive, hateful, or inappropriate content.
• Scrape, harvest, or systematically extract data from the App.
• Impersonate another person or entity.

10. Third-Party Services

The App integrates with third-party services including OpenAI, Microsoft Azure, Replicate, Fal.ai, Firebase, RevenueCat, and Google AdMob. Your use of the App is also subject to the terms and policies of these third-party services.

11. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROCKET DIGITAL LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

13. Indemnification

You agree to indemnify and hold harmless Rocket Digital Limited from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.

16. Termination

We reserve the right to suspend or terminate your access to the App at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
